General Terms and Conditions of NailScienceCo
 
Conclusion of contract 
These General Terms and Conditions (hereinafter referred to as “GTC”) of NailScienceCo apply to all processing and processing of orders from your customers (hereinafter referred to as “customers” or “you”) at online shops managed by NailScienceCo. 
The presentation of the products in the online shop does not represent a legally binding offer, but rather a non-binding online catalog. By clicking the “Order now” button, you place a binding order for the goods contained in your shopping cart. Confirmation of receipt of the order follows immediately after sending the order. A binding contract is concluded upon receipt of the order confirmation.
 
Voluntary right of return/right of withdrawal
We grant you a voluntary return guarantee of a total of 30 days from receipt of the goods, with the exception of reduced items, e-books and hygiene items (e.g. underwear), for which there is no right of return . If there is a right of return, you can withdraw from the contract by notifying us of the cancellation within 30 days of receipt of the goods and sending the goods back to us within 30 days of declaration of the cancellation, provided that the goods are complete and in their original packaging and are in unused and undamaged condition. Timely dispatch is sufficient to meet the deadline.
Please send the goods back in the original packaging with all accessories and all packaging components to the address we provided by email.

Delivery
Delivery is carried out by Post CH AG. Items are only sold in normal household quantities and only to end consumers.
Please note that, in exceptional cases, we are not obliged to deliver the ordered goods if we ordered the goods correctly but were not delivered correctly or on time. The prerequisite is that we are not responsible for the lack of availability of goods and that we have informed you of this fact immediately. If the goods are subsequently unavailable, we will immediately refund any payments you have already made.
If working days are specified as deadlines, we mean all days from Monday to Friday, with the exception of public holidays.
We reserve the right to refuse or cancel an order if the order was processed by software, engine, crawler, spider or other automatic web program or scripted behavior system or through the use of services Third parties that were used to place an order on your behalf were generated.
 
Payment 
Payment must generally be made by credit card or PayPal (for instant transfer see the following paragraph). You pay directly during the ordering process by entering your payment details. After completing the ordering process, your chosen payment method will be charged the actual invoice amount after deducting any discounts, etc. 
The goods will be dispatched after receipt of payment. 
You agree that you will receive invoices, credit notes, etc. in electronic or paper form.
 
Customs
Customers are responsible for compliance with import and customs regulations. Any resulting costs and fees must be borne by the customer.  
 
Warranty
The statutory warranty for defects applies. NailScienceCo expressly reserves the right to provide the customer with a defect-free replacement if defects in the purchased item are asserted and identified. 
 
Disclaimer
NailScienceCo contractual and non-contractual liability towards the customer is excluded to the extent permitted by law, except for damage caused intentionally or through gross negligence. 
NailScienceCo liability for consequential damages caused by defects and for vicarious agents and vicarious agents is excluded
We provide links to other sites on the Internet on our pages. The following applies to all of these links: We expressly declare that we have no influence on the design and content of the linked pages. We expressly distance ourselves from all content on all linked third-party sites and do not adopt this content as our own. This declaration applies to all links displayed and to all content of the pages to which links lead.
The contractual partner must immediately report any damage that may have arisen as a result of NailScienceCo’s action in writing within five (5) working days of NailScienceCo becoming aware of the damage event
 
Data protection

Force Majeure
NailScienceCo is not liable for damages resulting from loss of service or delays in service that arise due to unforeseeable events (force majeure) beyond the control of NailScienceCo, its legal representatives or its vicarious agents. Events of force majeure include, in particular, war, civil unrest, forces of nature, pandemics/epidemics, fire, power outages, official orders, lawful internal company work measures as well as the failure or performance limitation of communication networks and gateways of other operators.
 
Severability clause
If individual provisions are wholly or partially ineffective, this will not affect the validity of these general terms and conditions. Ineffective regulations must be replaced by conditions that come closest economically to the original conditions.
Deviations from these General Terms and Conditions are only effective if agreed in writing. 
 
Applicable law/place of jurisdiction
Swiss law applies exclusively. The provisions of the United Nations Convention on CISG (Convention on Contracts for the International Sale of Goods), also known as the Vienna Sales Convention, are excluded. In the case of contracts with consumers, this choice of law only applies to the extent that the protection granted is not withdrawn by mandatory provisions of the law of the country in which the consumer has his or her habitual residence.
The exclusive place of jurisdiction is the registered office of NailScienceCo or its legal successor, except in relation to consumers, in which case the place of jurisdiction applies to the consumer's Swiss place of residence.
